1. Acceptance of these Terms

By accessing or using Tutik you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. These Terms may be presented to you in the App and on the Site. Your continued use after any update constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your country, to create an account and use Tutik. By using the App you confirm that you are an adult parent or caregiver setting up and supervising the experience for a child in your care. Children may use Tutik only under the supervision and control of a responsible adult.

3. The service

Tutik helps families wind down at bedtime. Depending on your plan, features may include:

• a configurable bedtime routine;
• bedtime stories, lullabies, and calm ambient sounds;
• quiet companion games intended for the adult during wind-down;
• a Kids Mode with a device-native exit lock;
• optional Tutik Experience features, such as personalized AI-generated bedtime stories, custom recordings, and child personalization.

We may add, change, or remove features over time to improve the product. We aim to keep the bedtime experience calm and non-disruptive.

4. Accounts and sign-in

Tutik works fully without an account: your settings and content stay on your device, and using the App does not create an account on your behalf. (The App does generate technical identifiers for its own installation, which are described in our Privacy Policy.) If you choose to, you can sign in using a supported provider such as Google or Apple, which uploads your existing device data into your account and keeps your settings and content in sync across your devices. You are responsible for keeping access to your device and sign-in credentials secure, and for activity that occurs under your account. A small number of features — AI-generated stories and illustrations, Tutik Experience, submitting feedback, and Family sharing — require signing in; everything else, including writing your own bedtime story by hand, works with no account at all.

5. Acceptable use

When using Tutik, you agree not to:

• use the App for any unlawful, harmful, or abusive purpose;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the App, the Site, or their underlying systems;
• submit content that is illegal, infringing, or harmful, including through AI story prompts, custom recordings, or feedback;
• use the service in a way that could harm a child or misrepresent the App's purpose.

6. Tutik Experience and payments

Some features are part of an optional paid plan ("Tutik Experience"), sold as a subscription with a monthly and a yearly plan. Billing, renewals and refunds are handled by the app store you bought through — Google Play on Android or the Apple App Store on iOS — subject to that store's terms. We do not collect or process your payment card details ourselves. Subscription prices, billing periods, and renewal terms are shown at the point of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; on iOS the charge is made to your Apple Account and you can manage or cancel in Settings → your name → Subscriptions. You can manage or cancel a subscription in your app store account settings; deleting your Tutik account does not cancel it.

Buying a subscription requires signing in, because your access is maintained on our server: the store tells us when your subscription changes, and we keep your entitlement in step with it. That is what lets access end when a subscription lapses or is refunded, and lets a family group's members keep access while the owner's plan is active. See our Privacy Policy for what we store and which of the store's interfaces we use.

Where a feature is described in the App as a "preview" or otherwise not yet commercially available, no payment is taken for it and access may be limited or change before general release.

7. Your content

Tutik may let you create or provide content, such as custom audio recordings, prompts for AI-generated stories, child personalization details, and feedback ("Your Content"). You keep ownership of Your Content. You grant us a limited licence to host, store, and process Your Content solely to provide and improve the features you use. You are responsible for ensuring you have the right to submit Your Content and that it does not infringe others' rights.

8. AI-generated content

Tutik Experience can generate personalized bedtime stories using a third-party AI model (Google's Gemini via Firebase AI). AI-generated content is produced automatically and may occasionally be inaccurate, unexpected, or not to your taste. You are responsible for reviewing AI-generated stories before sharing them with your child. We provide AI features on a best-effort basis and make no guarantee about the suitability of any specific generated output.

9. Intellectual property

The App, the Site, and all related content we provide — including the Tutik name, logo, mascot, design, text, audio, and software — are owned by us or our licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for its intended personal, non-commercial purpose. You may not copy, distribute, or create derivative works from our content except as permitted by law.

10. Third-party services

Tutik relies on third-party services to function, including Google Firebase (authentication, database, storage, messaging, analytics, and hosting), Google Gemini for AI story generation, and Apple and Google sign-in. Your use of those services through Tutik may also be subject to their respective terms. We are not responsible for third-party services we do not control.

11. Disclaimers

Tutik is a wellbeing and entertainment aid for bedtime. It is not a medical, sleep-therapy, or childcare service and does not provide medical advice. The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any particular outcome will be achieved.

12. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of, or inability to use, the App. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer are not affected.

13. Children

Tutik is designed to be set up and operated by an adult. Children should use the App only with adult supervision. Parents and caregivers are responsible for deciding what content and features are appropriate for their child and for supervising use, including any Kids Mode session. 14. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features or legal requirements. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. The current version is always available at tutik.eu/terms.

15. Termination and account deletion

You may stop using Tutik at any time. If you have signed in, you can permanently delete your account and all associated data from within the App (Settings → Privacy & Data). If you have never signed in, there is no account to delete; you can remove everything Tutik has stored by clearing the App's data in your device's system settings. We may suspend or terminate access if you breach these Terms or use the App in a way that could harm other users, a child, or our services.

16. Governing law

These Terms are governed by the laws of the Slovak Republic, without regard to conflict-of-law rules, and subject to any mandatory consumer protections of your country of residence. Disputes will be subject to the competent courts of the Slovak Republic, unless mandatory law provides otherwise.
